Hi Guys:
My wife is out of country from October 2010. She was working on H1B. After birth of our son, she went to India for 6 month vacation. Will there be any issues if she re-enters US using H1B as she is having a job to continue with her employer.
What are all the documents I need to take.
Please advice.

I am starting this thread for the people who are Greencard Holders and not married. Please share some thoughts for bringing their spouse here.
IV can help in this matter.
If all visa holders and citizens can bring their spouse instantly then why GC holder have to wait for many years after getting GC after many years.

Hi All,
Please share your experience. This is quite urgent. My H1B(8+ year) is expiring, and my company is willing to file H1B with Engg manager role. My previous H1B or extension was files for software engineer. My GC(EB2) is filed as Software engineer, with PD as Jan 2006.
Questions
1) Now is it ok to file H1B with new title? What if H1B gets rejected?
2) How does this title change affect GC? Can the GC be cancelled because the title has changed or H1B gets rejected? The engg manager role is similar to software engneer role, except people responsiblities.
3) If the H1B gets accepted, then is there still a danger to GC? Do they verify GC papers before approving H1B?

My EAD got approved on 08/14/2007 - TSC - (USCIS Site Update) but still I am waiting for the Physical card � does it really take more than
15 days to be delivered..? or should I be concerned..?

Hi All,
My employer after too much of talks is ready to file. But in all the applications he wants to put his address so that he receives the EAD card and AP..He is not ready to put my address. Can he keep my EAD card ?

Hello,
I have a h1b visa that will expire in March 2010. This visa has been already renewed for its second time so, as you know, I wont be able to renew it once again.
Currently I am applying for permanent residency ( EB3 category) and I am in the AOS phase. I have the possibility of renewing EAD's every year, but I need to understand what is going to happen when the H1b expires. Can I renew EAD's even after the visa is no longer valid? How does it work?

My employer filed H1B transfer in Feb 2009. however he could not receive RFE letter with in time on mail and only received after RFE submitted date was expired which is May 25th, 2009
In jun1 1st week , he filed for the RFE extension for the stated reason and also refiled H1B to make sure that I should be in valid H1B status in case of first H1B denial in mean time
Employer submitted all the documents related to RFE on June 20th and it got approved on jul 1st.
What are the best options for H1B refiling case
in case if it is denied, will it super impose the original H1B approval ?

I think yes you can as far as you have valid copy of your I-140 approval new employer can start the process and you can port the priority date.

My parents-in-law visited the USA in the last week on B1/B2 visa. At the port of entry the immigration officer marked the expiration date on I-94 for my father-in-law for 6 months and however did not mark the expiry date on my mother-in-law�s I-94.
As they are visiting first time they did not know the procedure and they could not bought this to the immigration officer�s attention before they left ?
I assume they entered the expiry date in the system for my mother-in-law since both applications were processed at the same time with the same officer.
How this can be fixed ?
Is there any way I can call DHS and confirm the I-94 expiry date in the system ?

No one from EB3 category posting their success story of geting a GC recently. What does that mean, VB PD is just foolling us and making you to go crazy.

USCIS: National Processing Volumes and Trends (http://dashboard.uscis.gov/) .
Backlog for I 485 pre adjudicated application went up by 20k. USCIS has mentioned few times that they will pre adjudicate all cases by Oct 2009. So we may see increase in those number till Oct 2009 posting. After that we will see reduction. How much reduction.. No one can guess. But definitely EB2 will not get more than 25k per year so it will be easily 5 years to clear all backlog for Eb2. Number may go up because of Eb3 - Eb2 porting after one year when they get their labor approved.

Hi friends
I travelled out of USA and am trying to get back into USA with AP. I am using H1B(not stamped).
THey temporarily transferred to me indian office for this duration.
I also have EAD with me(not yet started to use).Now My co. is not letting me to go back to USA
without a project.If incase i want to change my employer, how can I do it..
Will it hurt to go back without employers permission to USA and then to use EAD to get a job?
After this I plan to submit my resignation.For EAD, 180 days already crossed.
If I want to do the above,how many days I have to get a job with EAD with a new employer after I go to USA?
What are my options?
