My 7th year H1-B renewal was mailed by my lawyer on March 30th to the Vermont Serice Center. They received it on March 31st. I know that there was a change in filing taking effect April 1st. What happened in my case is that the USCIS forwarded my files to the California Service Center without receipting it first. California reveiced my file on April 4th and now I find myself out of status. My lawyer tries to tell me that it was an USCIS mistake whereas a lawyers who I retained for a second opinion tells me it was the mistake of the first attorney. I did everything possible for the to reconsider their decision but I still would like to know who's to blame. If it was indeed the lawyera mistake I'm considering filing a complaint against him.

I jsut wondering which country/place got the strongest prospect for the multimedia industry... Australia/USA/Asia.......??
because I m thinking which places should I go to work if i want to work in this multimedia industry lets say for a couple of years..any suggestion??

Hi there,
Please correct me if i am wrong.
WH-4 Time line is within a year, means if betrayel/non payment happened with in a year from the date of reporting it will be investigated, and YOU CAN FILE WH-4 FROM OUTSIDE OF US ALSO, if your consultant company sent you back with fake commitments.
But not sure if your h1 still have time, after DOL complain, you can transfer it or not??
Anyone has any idea???

I have visa stamp in the name of previous employer and I 797 from current employer. I have traveled with these and had no problems at re-entry.
But previous employer has completed processing of my H1B cancellation. Can I still re-enter with visa stamp in the name of previous employer?

All,
My 485 was filed during the Jul 07 fiasco. My 485 online status became " fingerprinting fee has not been received and case will resume only after we get....". We even got a letter from uscis in oct 07 about this.
However we got a letter from USCIS again in Nov 07 that it was an error on their part and asked us to ignore the letter.
However the online staus remain the same.
Fingerprinting was done in sep 07, got couple of EAD's and AP's as well.
I have travelled once in AP and no issues.
Is there anybody else with the same situation?
Should i call the customer service and enquire?
Please advise.

LCAs for consultatnts definitely are challenging, since they move around so much. In your case, a new LCA is not required because the new position is in the same Metropolitan Statistical Area (basically the same town) as the old location.
In general, CIS and DOL distinguish between employees who are roving as part of their job, and those who are sent to a new location for a short term. The distinction is too complicated to go into here, but hopefully your company's attorney is well aware of it.

My employer is not willing to give the user id and password of the secured sire through which they filed the labor.

Status of PERM can only be checked by your employer (with their user id and password of the secured site). Unfortunately there is no other way to check the status.

I was wondering if there is a way to efile for renewal of EAD & AP or do we really need a lawyer. It is turning out to be too expensive to file for a renewal through my comany lawyer. If it is possible, can someone who has already self filed advise of the procedure?
