I am going to complete 6 years on H1-B by 2009 March. When we applied for the H1-B Transfter to my current company last year for some reason I got the extension upto Jan 2010 which is more 6 yrs.
I was on L1 until 2004 Jan for 9 months in the begining and my previous company converted L1 to H1 in Jan 2004.
My question is do I need apply H1-B extension on approved I-140 to get 3 more years extension as 2010 Jan will be my 7th year on H1-B ? OR I can wait upto current transfered H1 - B approval validity?
Please advise.

I've a situation here to switch from Company A (who sponsors my GC and H1B) to Company B, I've completed AOS (6 months period too):
1. Whether I can transfer my H1B (sponsored by company A) to company B when i join them? (but H1B is not stamped yet on PP) if not H1 transferrable, then I've to use EAD only.
2. Company B will ask me what papers I need for GC sponsorship either NOW or in FUTURE, can anybody know this? please help
3. I know that i need to file AC-21 to do the switch, what are the procedures like:
a. job position should be same or similar?
b. what paper work other than AC-21 needed to do this switch in changing employer information, fees for doing this change?
any help/advice would be greatly appreciated. Please let me know.

We have seen so much of visa retrogression all along.....I was thinking of the July fiasco...after effects....Just when i was thinking of How DOS advances the dates. It is really erratic...since they have no clue on the number of pending applications. While they want to advance the dates faster when they know USCIS will not be consuming all the 140K quota so they can have their overseas consulates process some of them in July it turned completely different More people opted for AOS v/s CP.... Wouldn't it make sense for them to have 2 different cutoff dates ?? 1 for USCIS and 2 for Overseas consulates . How will this help ? They can advance the dates more accurately. How does that affect the people already in USCIS queue...They can either choose to change AOS to CP. and since the dates are different on CP (better than that of AOS) this will make new people file more CP than AOS while a number of folks in uscis queue to move the CP route and hence relieve the pressure on USCIS. There will certainly be some disadvantages No EAD/AP etc when one goes the CP route v/s AOS but the wait will be minimal....
Again just a thought....

I left my Indian consulting company and the employer owes me $14,000 which he is now refusing to pay, he says he will deduct it as a cost of H1 and GC processing fees
When I started working for him he told me that he would take care of all these costs(of course he did not give this in writing) and not at anytime was there a verbal or written agreement that I would have to repay him these costs if I left him.
What recourse do I have now?

There is no biometric fee for AP. It is only if you are applying for a Re-entry permit or a Refugee travel document.

My H-1B expires next year (after 6 years). I have been here 10 years (on J-1 and then H-1B visa). My employer isn't in a position to apply for Labor Certification, although they want to continue hiring me. I want to stay (no relatives here etc.). I know after one year, I can return on a new H-1B if my employer will petition again but it is messy and I want residency. I am from Britain. Help!!!

Friends,
I need a clarification on EAD card usage. If your spouse whio has an independent H1B visa and whose 485 and EAD application is dependent on you, changes the work status from H1B to EAD, then does the status of the primary applicant also change to EAD automatically. Since the spouse's application was not independent filed and was a dependent on the original applicant for both 485 and EAD applications. I want make sure that the primary applicant's status ( separate independent H1B ) is not changed from H1B to EAD, just because of the spouse starting to use the EAD ( who is a dependent filer on primary applicant for both AOS and EAD ). Would appreciate your inputs.

My PERM was filed on July 18, 2007. PERM got approved on July 26, 2007.
I-140/I-485 concurrent will be filed in first week of august 2007.
Which fee will be applied in this case ? New August filing fee or same July filing fee?
USCIS FAQ are confusing for this scenerio. I am sure lot of people are in the same boat. Kindly let me know what is the right filing fee for this scenerio.

I think you can't apply more than six months in advance from the date your H1 is expiring.
I guess anytime August onwards should be good .

Here is my scenario...
1. Applied my first EAD thru some lawyer (hence G-28)
2. I am planning to renew it on "my own"
Can I renew EAD without Attroney help... I know the answer "YES" but the main question is... do I need to inform USCIS saying that I want to withdraw my lawyer's and hence G-28 which was filed along with my first EAD?
If anyone are sucessful, please help me...My question is not on how to self apply EAD..My question is whether we need to inform USCIS about G-28...

ABC News has an interesting piece that discusses the birth tourism controversy and quotes a statistic that actually comes from Lindsey Graham's office. According to the National Center of Health Statistics, just 7,760 mothers report that they live outside the US of more than 4,000,000 births each year. Keep in mind that some of these mothers are actually US citizens who reside abroad but want to have their children in the US. Senator Charles Grassley(R-Iowa) did not hesitate to invoke the dreaded "A word": "This memo give credence to our concerns that the administration will go to great lengths to circumvent Congress and unilaterally execute a back door amnesty plan." This question is for my wife. She is currently in her 5th year of H1 which expires in Oct-2011. i.e Her 5th year ends on Oct-2010. She is planning to quit her job now (Aug-2010) due to personal reasons and plans to switch to H4. Her employer (Company-A) has already filed for her GC and her LCA and I-140 is approved, but I believe they will be discontinued once she quits. So here are my questions -
1. Since she will have a little bit over 1 year remaining on her H1, can she file for H1 again if she get a new job offer?
2. Assuming that her next company (Company B), files for a GC within one year, Will there be a problem getting her H1B extended ? Since her new LCA (with Company-B) will be filed less than 365 days before her H1b expires.
3. OR Will USCIS look for the LCA filed by Company-A and grant her H1B extension?

(EB3-I I485 filed & pending, got married after July 2007 episode and missed filing I485 for my wife.)
So, cannot use EAD during these transitions and continuing H1 filings & extensions...
My current H1b is expiring on Sep 30 2010, I 94 expires on Oct 09 2010 (I know the officer at DFW POE was kind enough to give expiry 10 days beyond petition exp date).
My current company filed for normal extension during 3rd week of Sep 2010.
Now I got job offer from another employer, who wants me to join from 11 Oct 2010 or I can ask them to advance joining date to 06 Oct 2010 (to rule out the possibility of being out of status). They are ready to do H1B premium. (They claim their track record is good, & they get very minimal denials)
Did anyone face this situation?
Also, once the new employer's H1B is filed, does it come with I-94 cards in the petition notice? (If not, I would have to go out & get stamped, don't I?)
