Hi Gurus,
My PD is Aug 2005 (EB2 India). Last year, during September - October my case was picked up and I think it is processed, but because of lack of visa numbers, the case was not approved. (I wrote a senator letter, he got back saying that the file is processed and waiting for visa numbers)
Now, I got 2 offers. First one is a fulltime position and 2nd one is a contract with a primary vendor (directly working on W2 using EAD). I haven't decided which one to join.
What are the options, I have? Do I need to file AC21? Since my file is already processed and waiting for the PD to become current, am I OK, even if I don�t apply for AC21? If I file AC21 and if the job descriptions are not matching or because of any other issues, if there is an RFE, I will be having some issues.
Gurus please let me know your thoughts.

Dear Experts,
My wife's H1 is pending from H4. Its got selected in lottery and waiting for approval. But in the mean time we have to go to Canada and come back within 3 days. I would like to know if this impacts the COS. If it so, what are the options, means again can we apply for COS once we get the H1 approval without COS? Please let me know the options.

Hi Firas,
Expression Blend can be used if you are creating an application that uses XAML for the visuals such as one created in WPF or Silverlight. The logic can be done in C#. Therefore, the answer to your question is "BOTH - if you are planning on building your application in WPF or Silverlight".

Hello everyone,
I had come and been living in California since Feb 2010 under F1 visa.
My mom filed the form I-130 to petition me last year when my PD was current (Dec 2010), I filed the form I-485 to AOS. I got fingerprint done and was issued the EAD card plus a valid SSN and Alien number also. And last week I just got the INterview done at the local USCIS. Unfortunately, the officer said because the retrogression of visa bulletin, my PD wasnt current anymore, and all the paperwork was sent to NBC to be saved there and when my PD comes, they will issue me my GC.
I am currently going to school, and Im wondering if Im qualified for FAFSA, and am I considered as CA resident so that I dont hav to pay out-of-state resident?
Also, I will be filling out my transfer application to a university this FALL (Im going to a Community College now), what should I write for my immigration status and etc?
I will rly appreciate ur feedback!

My current h-1 B visa in passport expires May 1, 2007. And I have a I-94 valid till May 1, 2007. I already got 3 yr h-1 b extension valid from May 2, 2007. I have to travel to canada in March and I am planning to get the new H-1B visa stamping when I am there instead of making another trip.
Is it possible to go for visa stamping for the extension h-1b, when the intial
H-1B visa is still valid. My understanding is if the visa is issued, all the previous visas will be cancelled. In that case, Can I re-enter US in March with a H-1B valid only from May, 2007
I would greatly appreciate responses from any one who faced the same situation.

Hi,
I am planning to get my H1B extension Visa stamped in Montreal, Canada. i am in US right now. I have completed the online application. I have paid the fee through my credit card and the status of the transaction is showing as "Pending" in my bank account. I can able to see "MRV Fee Receipt Number". i can also able to see Schedule Appointment First Available: Friday, November 12, 2010 09:30 AM. But I am not able to schedule an appointment. All of the steps I performed on Yesterday. So I have waited for today for any changes and all remains the same.
Please help me.

If we lose our job after having the I-485 pending for more than 8 months, I-140 approved, how much time do we have to find another job?
Do we have to immediately withdraw the petition after losing/quiting a job?

I am on H1B and my wife is in H4 here. She is a nurse and can apply for the AOS before Aug 17 .But she does not have all certificate that makes her AOS approved at this time. We hope that we can obtain the certificate (Visa Screen certificate) by the time the RFE comes. But it is a 50-50 chance only. So what could be the best option for us and consequences of each.
My case (h1B)
1. I also apply for AOS with her so that I can get aGC along with her but do not use the EAD .
2. I apply for the AOS later but before her AOS approved.
My wife case (h4)
1. Apply for the AOS but do not use EAD
2. Apply AOS and use EAD.
Also do you know around when the USCIS issues RFE once the application is recieved?
I really appreciate your advice in this.

If I-485 is filed improperly, the application can be rejected and we need to resend again, however if the date move back, we will be stuck for years again.
What are the basis on which USCIS will reject the application, when the lawyer apply the application, what kind of evidence we should be double checking in our side, so that we do not have any potential for rejection.
If the fees are correct, if the forms are signed, all the initial evidence is provided? These are good enough to guarantee the acceptance of application.

My EAD and AP have the wrong birth date and I just noticed it. I have to re-send form I-765 and I-131 with the original EAD and original AP for correction. My case was originally filed in NSC along with 485, but I live in Texas.
But, as per instructions for I-765 and I-131, form should be filed at:
"Service Center with jurisdiction over your residence or Local Office - depending on where your case is pending."
Can someone guide me please ? Where should I file - TSC of NSC ?
