Hi All,
We are having same problem, received I-539 copy and it is showing class type H1b for my wife, and it is supposed to be H4.
Can anyone let me know what is the procedure for correcting class type??

It's true that Obama is focusing on the economy now, but if we do a massive flower campaign now it will get us press and attention and "loosen" things up, then we can go for a second even bigger flower campaign in the spring and in the summer when the previous flower campaign will still be alive in the public's memory. That way people will say "wait, legals? that's different than illegals, and it sounds serious"
We need to get ourselves noticed! The illegals had Obama on the Hispanic radio show with "Piolin Sotelo" last week. Why aren't we doing anything? We are not cowards, are we? The illegals can but we legals can't?

NYGal if you go to immigration.com then go to forums then Labor certification then Backlog centers the updated site is there in the forums under the title similar to my thread.

I am in my 9th year H1-B. I have my I-140 approved and I-485 pending since July 2007 through employer A (EB-3).
Employer B is willing to hire me on H1-B (transfer) using AC21 portability (and similarity of jobs). After the move, employer A will revoke my I-140 for sure.
Can I apply for an H1-B transfer with employer C after a year or two using AC21 portability? I do not want to use EAD. I want to use H1-B tansfer (3 year extensions)?
This is a major decision that I have to make.
Please reply at your earliest convenience.

What is the difference been EB2 Vs EB2 NIW and when does one qualify for NIW
National Interest Waiver means that you do not have to have a job to petition for EB-2 GC. Consequently, there is no labor certification requirement. NIW petition is your petition; not some employers.

I applied for AP and EAD renewal in July 2010. I need to go to India by Oct 1st week for some personal work which can not wait beyond that time.
I am planing to expidite my AP if I wont get AP by then. What can I do with my EAD?
- Do I need to be present in US for EAD or I can leave US and ask my friend send EAD to India when it gets approved?
- If I go to India before EAD approval and if I am called for finger printing what are my options? Like, if I dont/cant come by the finger printing appointment date what happens ?
I appreciate for your reply.

Recently I transferred my H1 to another company. My H1 and my wife�s H4 got expired on last August 2nd 2007. However, the new company filed H1B application and it got approved 2 weeks back, but forgot to file for H4 extension for my wife. My company is saying they will file for H4 extension (I-539) now, even though her visa/I-94 got expired and she doesn�t have to go back home. Do you think they are on right track? I�d really appreciate if anyone could suggest me on this.

If H4 uses EAD for work with 485 pending, and if the underlying I-140 gets rejected, will this make H4 holder be out of status? what are the options for H4 holder.
If I 140 is rejected then the EAD,AP and I 485 are rejected as well. If you have used EAD then ur H4 is no longer valid ! You will have to go out of the country and get H4 stamped.
So the recommendation is to keep H status alive till you get Greencard

I am on H1B and planning to go for CP. I have to fill the form DS-230 for this and submit to VSF office.
Currently I am on H1B extension and I don't have visa stamped for this extension on my passport.
In this form DS-230 I need to fill field name "Present Address".
I have following question:
- In this form what should I fill my present address
Indian address
OR
US address.
(what I think: I think when I will submit the forms to VSF I will be in india and at that time i will not have the valid visa to enter USA. So I think I should fill the indian address.)
What do you guys suggest?

Hi,
My I-485 case was approved on 7/23, got approval letter on 7/30.
In August I got the Code 3 Biometrics letter and now I got it for Code 2. Two Biometrics appointment within a month!
Does this usually happen? No CPO e-mails or card yet!

I know lobbying takes money, but i am not sure how much we need.
I see lots of emails about funding going around, but i am not getting any idea of how much exactly is needed.
Can the admins post a funding drive! and set some target - say, "100000$ funding drive". If we have a target, we can pitch in money and try to meet that. If we fall short, we know how much we need more, so that people can make extra contributions.
Once again, this is just my random thoughts.

I am using Advance parole in december to visit India. I have applied my canada PR in 2008, but I don't have stamp of PR in my passport.
Is there are any problems using AP for India visit.
