Hi
I am currently working on H1B visa. I also had an EAD which expired 2 months back & I applied for renewal of the EAD last month. I am at the risk of being laid off by my current employer & they will withdraw my H1B if that happens. Here are my queries-
(1) If I lose my H1 status & my EAD approval is still pending, what do I need to do? If I am unable to find a new H1B sponsor, will I have to leave US immediately?
(2) Will my H1 cancellation have any effect on my EAD & AP renewal petition?
(3) Can I return to US & work after my AP & EAD are approved?
(4) If my EAD approval happens before my H1B visa is revoked, can I legally stay & work in US on the basis of ONLY the EAD?

I will not suggest you to do anything in DR. They are not really very organized and it take time even to get a DR visa but that just my personal opinion. Consult your lawyer..

Hello,
I have already filed I-751 under removal from country results in extreme hardship,I am going through divorce process,I want to change cateogory in I-751 [marrige entered into good faith but terminated by divorce] ,so please anybody can tell me that when I will get me my divorce decree I have to refile new I-751 for cateogory change into------marriage entered into good faith but terminated by divorce.so plz help me i need to refile or just only amendment letter to uscis.if any body has gone through this process plz help me.

Any advantage of opening an account on USCIS website to receive automatic case status updates? or I don't need to do that if I keep checking the status online by myself?
They send you and email if something changes, nice if you have a Blackberry/pda
If you have multiple cases i-129, i-131, i-140, i-485 you can see them all on one page, I find that easier to see LUDs in particular the "soft" non-action ones, but it's nice to know the file was touched.

Should be pretty straight forward. Ask her to take the signed I-20, financial support docs, letter from the department, and also from advisor (if possible). Though in our case, the VO didnt ask for a single doc but its good to have them all.

Hi All,
My H1B(8+ year) is expiring, and my company is willing to file H1B with Engg manager role. My previous H1B or extension was files for software engineer. My GC(EB2) is filed as Software engineer, with PD as Jan 2006.
Questions
1) Now is it ok to file H1B with new title? What if H1B gets rejected?
2) How does this title change affect GC? Can the GC be cancelled because the title has changed or H1B gets rejected? The engg manager role is similar to software engneer role, except people responsiblities.
3) If the H1B gets accepted, then is there still a danger to GC? Do they verify GC papers before approving H1B?

These numbers include Family Based and as per my understanding 90 % of the applications are FB based.
For us who are EB based, the EB backlog should be more realistic and I am not sure how do we get them!

1. Got Ph.D three years ago
2. worked in a hospital as a PI and postdoc training for three years
3. worked as research associate at University of Houston last year
4. working as research assistant professor(Faculty) at UH
5. Four foreign grants including national grant
6. several awards including the First Prize awards in foreign provincial health field
7. Published more than 20 papers, only two are SCI (one is PNAS published this year without citation so far), others are foreign language papers have more than 40 citations.
Now I am preparing files and will apply as EB-1b.
can you tell me the best points to claim?

Hello everyone, thanks in advance for any reply.
I mailed in my wife's I485 and I130 together (she's from China, and we just got married a month ago), and I just realized that I forgot to include the marriage license with the forms!
Now, what are my options? I noticed that they have not cashed my 2 checks yet, should I cancel them so I at least don't get charged for the forms that will be rejected?
Or, is there any way for me to mail the marriage license separately and hope they get it?
Right now, I think it would be better to just redo the forms, but do I have to wait for the forms to get rejected first?
