Hello there, nice website.. i hope someone will know the solution to my problem :)
I saw another post in this forum like this, but my situation is a little different.
I'm actually in New York University with a F-1 made at the US Consulate in Italy (my country)
Unfortunately i've lost my i-94 form that was attached to my passport.
i saw the I-102 form, with the 320$ fee. If needed i will pay this amount, but since i'm finishing my studies in two months someone told me that i will never back in time the copy of my I-94.
I'm planning to have a trip in Canada with some my friends, i've asked the permission at the university they told me that is ok.
Do you think that i can go outside the US without the i-94 (by car)? at my friends they will remove it?
Secondly, i'll have a new I-94 getting back in the US few days laters?

Good news. The U.S. Citizenship and Immigration Service (USCIS) recently issued guidance on the new H-1B amendment that limits Troubled Asset Relief Program (TARP) recipients� ability to hire H-1B workers. The USCIS confirmed that the new H-1B amendment does not apply to H-1B extensions for current employees with the same employer.
"EAWA does not apply to H-1B petitions seeking to change the status of a
beneficiary already working for the employer in another work-authorized
category. It also does not apply to H-1B petitions seeking an extension
of stay for a current employee with the same employer."

- Bsc Computers (3 yrs) + MBA (2 yrs)
- GC - EB3, Oct 2003.
- Applied for 9th Year H1B in October. (H1B Visa expired in Oct)
- EAD and AP approved.
- Just got CRIS email of I140 & 485 denial notices (waiting for the USCIS letter for reasons).
- Previous company closed down and I had given Experience letter from a colleague, who is now on H4.
Questions?
1. Am I out of status already due to denial notices?
2. Will I get an H1B Extension?
3. If my lawyer decides to file an MTR, will I be allowed to work until my EAD/H1B is valid.

Hi,
Since iam nursing my son,mmr vaccination was not given to me.i saw my report and compared.In the contraindication colomn ,he checked for MMR vaccination.This means for some reasons(or if under medication) i was not given this vaccination?Did anyone experience this?will i b asked to take it ?

Hello, I apologyze for not giving my name away first of all, secondly I need to know what my options are if my father and mother who are permanent residents in the USA can file an I-130 for me? They obtained their legal status thru the department of labor but at the time they were approved I was already 21 years of age (the whole process started in 2000and lasted for 5 years or so); one lawyer told me that I cannot do anything since I was over 21 but I just have been in a different lawyer who told me that yes I can adjust my status thank to a grandfather law that can help me to achieve my goal in working legally in this country. I am an unmarried daughter and 27 years of age at this time.
I just don't want to spend those $5,500 can this lawyer is asking me for his services, I appreciate very much your replies and my family will too

i have been offered a job at my current research centre where i worked as a student. I want to go back to my home country. The job can be done online and does not require physical presence in the USA. Will i still need an OPT? or can they employ me as an international worker? if they wmploy me as an international consultant then what are the ramifications for teh company? wht is the legal procedure? will they have to pay taxes more etc?
Please help

Yes for extensions - Auto revalidation only from contiguous countries - Canada, Mexico and some islands.

Just i have applied for AP through efile. From here what's the procedure? Do i need to send the support documentation? if so, what are all the documents i need to send? please through some light on this. also will i get another bio metrics appointment?

Currently I am on H1B visa.I will file my 485 as secondary applicant.What are my options in case If I have to leave my job and my 485 is still not approved.
Do I need to file H4 (Since 485 is still not approved) ?

You can status will be Adjustment of Status ( AOS ) but cant work . IYou need a APO if you want to travel . If you want to work you need an EAD .

Can someone give me any suggestions?
I have filed for my AOS, last week.. I am assuming that i will get my EAD, AP in next 3-4 months......
a.) Once we get our EAD's can we go to India for a period of 6 months...even without receiving our physical GC? and yet return to US??
b.) After filing for AOS, can we leave US for a long period (6 months)..so in that case will we still get our EAD/AP/GC's???????
any answers?

Both cards should arrive to the address that CIS has on file for the couple. The wife's departure from the US should not affect this. However, she needs to have the card to return to the US, ideally. Hopefully husband can send her the card.
